This is a two-part presentation on representing juveniles in criminal matters. In Part I, Juvenile Justice, our distinguished presenters will describe in-depth how to represent a juvenile in a criminal matter. The following topics will be discussed: stationhouse adjustment, what to do when a juvenile is arrested, summons vs. warrant, juvenile arrests with specialized units – homicide unit, taking statements of juveniles, the 6 hour rule (including interrogations and detentions), what is needed to resolve a case, protections of juveniles when they are charged with T.L.O. and school searches.

In Part II, Representing Juveniles with Autism in Criminal Matters, our distinguished panel will discuss the fact that while most juveniles with autism are law abiding citizens who are much more likely to be victims of bullying and crimes than perpetrators, there are special considerations to be understood when representing juveniles with autism. Many criminal statutes enforce social norms that are presumed to be understood by the community and not specifically taught. In addition, many of these statutes, especially regarding pornography and sexual offenses, do not require knowledge of wrongdoing to be violated. However, these community norms may not be understood by autistic children as autism is diagnosed in individuals with a “markedly impaired” ability to grasp “norms for social interaction” “in their cultural context.” (DSM-5). In addition, these children are entitled to special education services that may or may not be being provided appropriately by their school districts. Therefore, when representing children with autism who are accused of crimes, it is important to understand autism and the interplay between criminal and education law.
